Music Data Sales Terms of Use
Article 1 (Purpose)
These Terms of Use (hereinafter “these Terms”) establish the conditions for the purchase and use of physical products (microSD cards) and download products (hereinafter collectively referred to as “Products”) of music data provided through the EC site “MUSIC HEAD original music online shop” (hereinafter “this Service”) operated by MUSIC HEAD (hereinafter “the Company”). All customers using this Service (hereinafter “Users”) are deemed to have agreed to these Terms.

Article 2 (Types and Characteristics of Products)

  • Physical Products (microSD Cards)
    • The microSD cards sold by the Company contain recorded music data (such as WAV and MP3 formats).
    • Ownership of the Product transfers to the User upon arrival of the Product to the User and full payment of the price.
    • No re-provision of data will be provided in case of loss, damage, theft, etc., of the microSD card.
  • Download Products
    • Download Products provide music data in digital format.
    • Users must complete the download within the period specified by the Company.
    • Download Products grant non-exclusive usage rights limited to the User’s personal use and do not transfer ownership.

Article 3 (Copyright and Usage Restrictions)

  • The copyrights and neighboring rights of the music data provided by this Service belong to the Company or the rightful rights holders.
  • Users may use the Products only for the following purposes:
    • Personal use (private listening, playback on personal devices).
  • The following actions are prohibited:
    • Reproduction, modification, distribution, public upload, or commercial use of the Products.
    • Transfer, lending, or sale to third parties.
    • Circumvention or removal of DRM (Digital Rights Management) technology.
  • If a violation of these Terms is discovered, the Company may suspend the User’s account and take legal action.

Article 4 (Management of User ID and Password)

  • Users are responsible for registering the User ID and password (hereinafter “Account Information”) necessary for using this Service and managing them appropriately.
  • Users must not disclose, lend, or share Account Information with third parties.
  • The Company bears no responsibility for any damages resulting from unauthorized access or improper use of this Service due to inadequate management of Account Information.
  • If a User suspects leakage or unauthorized use of Account Information, they must immediately contact the Company and follow the Company’s instructions.
  • If the Company detects unauthorized use or suspicious activity of Account Information, it may temporarily suspend or terminate the User’s account.

Article 5 (Purchase Procedures and Payment)

  • Users shall select Products and complete the purchase procedures in accordance with the instructions of this Service.
  • Payment methods shall be by credit card or other methods specified by the Company.
  • For physical products, shipping fees (principally free) will be clearly indicated at the time of purchase. Download products do not incur shipping fees.

Article 6 (Delivery and Download)

  • Physical Products
    • Products will be shipped within 3 business days after order confirmation. Delays may occur depending on shipping conditions.
    • Sales and delivery destinations are limited to within Japan.
  • Download Products
    • After purchase, Users can download the Products from the link or account page specified by the Company.
    • The downloadable period is 7 days after purchase, with up to 3 downloads possible. Re-downloads are not possible after this period.

Article 7 (Returns and Refunds)

  • Physical Products
    • Due to the nature of digital content, returns and refunds after purchase confirmation are not accepted. However, for defective products, please notify us by email within 7 days after product arrival regarding the condition; we will handle it at our full expense. After returning the product by prepaid shipping, we will promptly send a new product.
    • Returns due to the User’s convenience are not accepted in principle.
  • Download Products
    • Due to the nature of digital content, returns and refunds after purchase confirmation are not accepted. However, if the data is damaged, the Company will provide alternative data. Up to 3 downloads are possible per purchase. If all data is corrupted after 3 downloads, please contact us, and we will respond promptly.
  • If a refund occurs, it will be processed within 30 business days according to the payment method.

Article 8 (Handling of Personal Information)

  • The Company uses Users’ personal information for providing this Service and related operations (such as delivery and support).
  • For details on the handling of personal information, please refer to the Company’s privacy policy.

Article 9 (Disclaimer)

  • The Company bears no responsibility for temporary suspension or termination of this Service due to natural disasters, server failures, legal changes, etc.
  • The Company bears no responsibility for any damages resulting from the User’s violation of these Terms or inadequate management of Account Information.

Article 10 (Amendment of Terms)

The Company may amend these Terms as necessary. Amended content will be posted on the this Service website, and it will take effect from the date of posting.

Article 11 (Governing Law and Jurisdiction)

  • These Terms are governed by Japanese law.
  • For disputes related to this Service, the Sapporo District Court shall be the exclusive agreed jurisdiction for the first instance.
